Changes to Terms

These Terms may be updated at any time. Continued use of the site constitutes acceptance of the revised Terms.

Reservation of Rights

Binding Arbitration

Any disputes, controversies, or claims arising out of or in connection with these Terms and Conditions—including their existence, validity, breach, or termination, shall be exclusively resolved through final and binding arbitration in San Mateo County, California, in accordance with the rules of the American Arbitration Association (AAA), unless otherwise agreed in writing by both parties.

Jury Trial Waiver

By agreeing to these Terms, you and Methena each knowingly, voluntarily, and irrevocably waive the right to a trial by jury for any claim or dispute related to these Terms and Conditions, including any claim for breach of contract, tort, or otherwise.

Attorney’s Fees and Legal Costs

In the event of any dispute arising under or in connection with these Terms and Conditions, the losing party agrees to pay all reasonable attorney’s fees, arbitration costs, court fees, and other legal expenses incurred by the prevailing party, unless otherwise prohibited by law.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis, and not as a class action, consolidated action, or representative proceeding. The arbitrator or court shall have no authority to consolidate more than one person’s claims or to otherwise preside over any form of a class or representative proceeding.
